The motion for leave to intervene by John Howard Society of Saskatchewan is granted in part, on the issue of the impact of s. 4.1(5) of the Controlled Drugs and Substances Act on the interpretation of s. 4.1 of the Act. John Howard Society of Saskatchewan is directed not to raise the experiences and perspectives of people exiting custody or to supplement the record with fresh evidence. The intervener shall be entitled to serve and file a single factum not to exceed ten (10) pages in length on or before August 26, 2024. The said interveners or groups of interveners are each granted permission to present oral argument not exceeding five (5) minutes at the hearing of the appeal. The appellant is granted permission to serve and file a single factum in reply to all interventions not to exceed five (5) pages in length on or before September 3, 2024. Leave to intervene is denied to Empowerment Council; HIV Legal Network and HIV & AIDS Legal Clinic Ontario; Canadian Students for Sensible Drug Policy; Community & Legal Aid Services Program; as these motions raise new issues. These interventions, if allowed, would have the effect of expanding the case. The interveners or groups of interveners are not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties. Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners or groups of interveners shall pay to the appellants and the respondents any additional disbursements resulting from their interventions.
