The applicants are parents of fraternal twins who were born prematurely. Following the birth, one of the twins was hospitalized because of serious respiratory problems. The parents claimed damages from 16 professionals involved in their son’s medical treatment. The court determined that, for each category of professional being sued, the proceedings were unreasonable and excessive, and it therefore dismissed the parents’ application. It then declared the parents to be quarrelsome litigants. The parents sought leave to appeal from the Superior Court’s decision, which was refused. The Court of Appeal was not satisfied that the proposed appeal raised a question of principle or a new or controversial issue that should be submitted to it.
