AND HAVING READ the material filed;
IT IS HEREBY ORDERED THAT:
The motions for leave to intervene of the applicants, Criminal Lawyers' Association (Ontario), Canadian Bar Association and Barreau du Québec are granted and the applicants shall be entitled to serve and file a factum not to exceed 10 pages in length on or before January 11, 2008.
The motions for an extension of time and for leave to intervene of the applicants, Amnesty International, Association des avocats de la défense de Montréal, Attorney General of Ontario and Association Québécoise des Avocats et Avocates en Droit de l'Immigration are granted the applicants shall be entitled to serve and file a factum not to exceed 10 pages in length on or before January 11, 2008.
The respondents are granted permission to file a reply factum to each interventions not to exceed 10 pages in length on or before January 18, 2008.
To the extent that the interests are similar, interveners shall consult to avoid repetition.
The requests to present oral argument are deferred to a date following receipt and consideration of the written arguments of the parties and the interveners.
The interveners shall not be entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties.
Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners shall pay to the appellant and respondents any additional disbursements occasioned to the appellant and respondents by their intervention.

C-23, s. 12 - Immigration and Refugee Protection Act, S.C. 2001, c. 27, s. 78(e).

In the context of a fourth detention review after a security certificate was issued against him, the Appellant disputed certain new allegations by the Respondent ministers. Following the review hearing, which had been postponed, the designated judge terminated the detention. However, the main proceeding for deportation of the Appellant from Canada was still pending. The Appellant argued that the main proceeding was tainted by the destruction of sources of evidence and should be quashed, or that, at the very least, this new part of the evidence should be struck from the record.

The Federal Court dismissed the Appellant’s motion and the Federal Court of Appeal affirmed that decision.
