Criminal law - Defence - Defence of mental disorder automatism - Whether judge had to put defence of mental disorder automatism to jury - Whether judge erred in his charge as regards expert evidence - Whether judge had to instruct jury on impact of accused's mental state.

Jocelyn Hotte was charged with the first degree murder of his former girlfriend and with three counts of attempted murder. He argued that he could not have planned his actions because he was suffering from depression at the time of the incidents. The jury rejected this suggestion and convicted Hotte of the alleged crimes. The Court of Appeal dismissed the appeal, Beauregard J.A. dissenting.
