Judgment on the appeal rendered, CJ B W LeD LaF, The appeal is allowed, the judgment of the Court of Appeal is set aside and the Superior Court judgment is restored but it is varied so as to read as follows: Awards custody of the children Hélène and Xavier Chrdon to Thérèse Vignaux-Fines and Daniel Fines; Grants the father Guy Chardon the following visiting and outing rights: a visit lasting a full weekend every three weeks, from Saturday at 9 a.m. to Sunday evening at 8 p.m.; or longer if the children wish; a week during the summer holidays; or longer if the children wish, provided Mr. Chardon gives one month's prior notice; Orders that the school reports be given simultaneously to the Fines and the father by the institutions attended by the children; Orders that the father have complete freedom to write and telephone his children: the telephone to be used reasonably; Orders the provisional execution of this judgment notwithstanding appeal and without security. The whole without costs. There will be no order as to costs in this Court nor in the Court of Appeal. Allowed, no order as to costs |
