Summary

Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.

Paul Kierans, who suffered from a serious developmental disability, resided in a group home residential facility operated by L’Arche Greater Vancouver, from 1992 until his death in April 2024. Prior to his passing, two of Paul’s sisters, Margaret Mary Kierans and Kathleen Walker, each filed a petition seeking to be named “committee” for the care of their brother.

A judge at the Supreme Court of British Columbia dismissed Ms. Walker’s petition for committeeship, and granted Ms. Kierans’ petition for committeeship instead. This decision was upheld by the Court of Appeal.
