Torts — Motor vehicles — Burden of proof — Applicant injured in motor vehicle accident contending she was not the driver at the time of the accident — Where the issue in a civil liability case is who was driving a vehicle causing the plaintiff injuries, and where the occupants of the vehicle were known, is it necessary that the plaintiff prove on a balance of probabilities which occupant of the vehicle was driving the vehicle, or is it the court’s role is to find, on a preponderance of evidence, who was more likely driving the vehicle? — Did the trial judge commit an overriding and palpable error of law in finding that the preponderance of evidence did not prove that the respondent was more likely than not driving the vehicle? — Did the trial judge impose on the applicant a higher standard of proof than was required?
Summary
Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.
On March 5, 2016, the applicant, Ms. Dutton, was seriously injured in a motor vehicle accident when her vehicle struck the side of a semi-trailer on Highway 97, near Chetwynd, British Columbia. The respondent, Ms. Schwab, was the only other occupant of the vehicle at the time of the accident. The main question for the court was who was driving the car. The trial judge stated that Ms. Dutton failed to prove that it was more likely than not that Ms. Schwab was the driver and dismissed her action. This decision was upheld on appeal.
