2024-05-29 | Order on motion to adduce new evidence, by JUSTICE CÔTÉ | |
2024-05-29 | Decision on motion to adduce new evidence, Côt, UPON APPLICATION by the respondents for an order granting leave to adduce further evidence; AND GIVEN the appellant’s consent to the motion to adduce further evidence, on the condition that the appellant be permitted to also adduce two (2) additional documents; AND GIVEN the respondents’ consent to the appellant’s suggested condition; AND THE MATERIAL FILED having been read; IT IS HEREBY ORDERED THAT: The respondents’ motion to adduce further evidence is granted, and the appellant is allowed to file the two (2) additional documents. Although the further evidence sought to be adduced by the respondents may have been previously available, the criteria for fresh evidence set out in Palmer v. The Queen, [1980] 1 S.C.R. 759, should nonetheless be applied in a flexible manner in this case, having regard to the nature of the additional evidence sought to be included in the record. As well, the appellant has indicated its consent to the inclusion of these documents. With respect to the appellant’s request that two (2) additional documents be included in the record, the respondents consent to this approach. It is therefore not necessary for the appellant to file a separate motion or a supplementary record. Granted |
