The motion is granted.

If the application for leave to appeal is granted, the respondent shall be permitted to serve and file a single factum, addressing both the issues on the appeal as of right and the issues on the leave application, not to exceed forty (40) pages in length, record and book of authorities, if any, within eight (8) weeks after the filing of the notice of appeal.

Should leave be dismissed, the respondent shall serve and file its factum, record and book of authorities, if any, within thirty (30) days of the date of the judgment on the application for leave to appeal.

The respondent is granted permission to present oral argument at the hearing of the appeal, pursuant to Rule 71(3) of the Rules of the Supreme Court of Canada.
