The order of the Court of Appeal is set aside, and the respondent’s convictions are restored. The acquittal on the charge of sexual assault is set aside and the proceeding on that charge is stayed. The matter is remitted to the Court of Appeal for determination of the respondent’s sentence appeal. Brown and Kasirer JJ. dissent in part.
