2020-10-16 Judgment on the appeal rendered, CJ Abe Mo Ka Côt Br Row Mar Kas, The appeal from the judgment of the Federal Court of Appeal, Number A-206-17, 2018 FCA 223, dated December 7, 2018, heard on December 12, 2019, is allowed with costs throughout. The following declaration is issued: there has been a breach of the rights guaranteed by s. 15(1) of the Canadian Charter of Rights and Freedoms of full-time Royal Canadian Mounted Police members who temporarily reduced their working hours under a job-sharing agreement, based on the inability of those members to buy back full pension credit for that service. Any remedial measures taken by the government to facilitate buy-back of pension credits should be in accordance with the Court’s reasons and should have retroactive effect. Côté, Brown and Rowe JJ. dissent.
